LPA Receivership

Waterfold Asset Management act as LPA Receiver for a number of specialist and high street lenders throughout the UK.

We receive initial instructions on both an arrears and full exit basis with the ability to transition between these options as the case develops. Our Collections and Asset Sales teams work closely on every case to provide continuity in communication with the Client and borrower.

Our modern case management system allows both teams to work concurrently on individual cases and across clients and borrowers ensuring efficient management and clarity of reporting. Our processes optimise how each case is dealt with delivering resolution quickly and effectively.

All appointments include:

  • Appointment legally validated within 24 hours
  • Appointment accepted by named LPA Receivers within 24 hours
  • Collections process commenced on day of acceptance
  • Initial strategy report on day 5 or 10
  • Updated strategy reports as required
  • Property visit, occupancy check, independent valuations
  • Securing property, tenancy management, rent collection as required
  • Full management of auction or traditional agency sale

In addition, access to in-house surveying, property management and legal teams is standard providing the capability to deal with any issues immediately as they arise.

What is an LPA Receiver?

In the UK, an LPA (Law of Property Act) receiver is a professional appointed by a lender to take control of and manage a property when a borrower defaults on a mortgage or loan. The receiver’s primary role is to protect the lender’s interests by maximizing the value of the property, rehabilitating the loan or facilitating its sale. This legal remedy is often used in cases of financial distress or insolvency. LPA receivership grants the receiver broad powers to manage the property, collect rent, and sell it to recover the outstanding debt. The receiver’s powers and duties are defined by the terms of the security documentation and relevant legislation.
